人道军事干涉与国际人道法

Humanitarian Military Intervention and International Humanitarian Law

虽然从现有国际法的规定来看,人道军事干涉并不具备明确的法律依据,但冷战结束以来,一国或国际组织对一个国家内部事务进行人道军事干涉的事例仍然有所增加。毫无疑问,人道军事干涉必须适用国际人道法。然而,由于国际人道法本身的严重滞后性使得人道军事干涉适用和遵守国际人道法存在诸多法律难题。因此,国际社会只有从国际法上严格限制这种人道军事干涉行为的发生,并且加快完善现有国际人道法的步伐,才有可能应对和解决上述出现的诸多法律问题。

Although according to the existing international law,especially the provisions of the Charter of the United Nations,humanitarian military intervention does not comply with the provisions of international law,since the end of the Cold War,a State or other international organizations constantly intervening the internal affairs of a country for humanitarian purposes.There is no doubt that international humanitarian law shall apply to humanitarian military intervention.However,because of the serious lag of the international humanitarian law,the application of international humanitarian law in humanitarian military intervention has given rise to a number of legal issues.Thus,only if the international community strictly limits humanitarian military intervention under international law,and perfects the existing international humanitarian law,will it be possible to solve the above problems.
