新时代背景下宪法与党内法规的结合与互动

Combination and Interaction Between the Constitution and Party Regulations in the New Era

我国现行宪法产生的历史充分体现出党与国的密切互动,这一特征是与党对国家的领导结合在一起的。也即,我们的根本法在产生之初,其特色即是与党的路线、方针和政策及党内法规等有着密切的联系。作为执政党,中国共产党对自身的路线、方针、政策的探索,以及自我管理和约束的强化,对于整个国家治理具有重要意义。因此,党内法规的发展也就与国家宪制的发展紧密结合在一起。党内法规的发展既推动宪法的变迁,也反映宪法的变迁。回顾我国宪法变迁的历程,可以更深刻地认识党内法规的发展。正如历次宪法的修改都体现出党章发展与宪法发展的互动,体现出宪法对于党所确立的思想路线和政策目标的确认。2018年宪法修改作为新时代的第一次修宪,作为宪法发展历程中的一个里程碑,更充分地体现了这一点。宪法在党的领导下实现对政治共同体的建构与整合,这一基本特征也就决定了宪法和国家法所构建的国家治理体系要和党的治理结合在一起,新时代宪法的发展同样也为党内法规在新时代的发展提供了重要动力。

From the perspective of history,the birth of the PRC Constitution fully reflects the close interaction between the Party and the state.This characteristic of the Constitution is combined with the leadership of the Communist Party of China over the country.In fact,at the beginning of its establishment,our fundamental law was characterized by its close connection with the Party’s basic line,principles and policies,and inner-Party laws and regulations.As the ruling party for a long time,CPC’s exploration of its own line,principles and policies,as well as the strengthening of self-management and restraint,have great importance to the governance of China.Therefore,the development of inner-Party laws and regulations is also closely linked with the development of the Constitution.The development of inner-Party laws and regulations not only promotes the development of the Constitution,but also reflects the changes of the Constitution.Under the leadership of the Party,the Constitution has realized the construction and integration of the political community.This basic characteristic determines that the governance of the state,which is constructed by the Constitution and national laws,should be combined with the governance of the Party.In the new era,the development of the Constitution also provides an important impetus for the development of inner-Party laws and regulations.
