从制度到法规:改革开放以来党内法规制度研究进路的嬗变——基于对CNKI数据库相关期刊文献的分析

From System to Regulations:The Change of Research Direction of Inner-Party Laws and Regulations Since the Reform and Opening-up——Based on the Analysis of Articles from the CNKI Database

以党的制度和党内法规为研究进路,按照本体、发展、运行、范畴、价值和学科研究六大主题,考察改革开放以来党内法规制度研究的期刊文献,可以发现:研究进路实现了从党的制度到党内法规的转向;不同进路之下,不同时间阶段内,研究主题有所嬗变。制度进路是党内法规制度研究的重要传统,以马克思主义理论学科的学者为主体,重点关注党内法规制度的运行和发展研究,注重对制度建设的历史发展和现实问题的探讨,对党的制度的一般化、理论性研究则有所不足。法规进路在2014年之后占据主要位置,法学学科的学者对党内法规概念、性质等本体问题和依规治党的实践路径进行了规范化的理论建构,但理论移植的色彩较为明显。党内法规的性质之争贯穿研究始终,有必要认真梳理党内法规建设的演进历史,准确把握党内法规性质,结合一般法治规律,创建符合中国共产党实际和中国实际的党内法规理论。

In directions of Party system and Party regulations,according to the six major themes of ontology,development,operation,category,value and disciplinary research,analysing articles on the study of inner-Party laws and regulations since the reform and opening-up,we can come to these conclusions:Firstly,there has been a shift in the research direction from Party system to Party regulations.Secondly,the research theme has also changed in different directions and periods.The research direction of Party system is an important tradition in the study of inner-Party laws and regulations.Scholars of Marxism focus on the development of inner-Party laws and regulations system,attach great importance to its historical course and practical problems,but overlook the general and theoretical research on the Party system.The research direction of Party regulations has become the mainstream since 2014.Scholars of jurisprudence have constructed the theory of inner-Party laws and regulations,including essential problems such as the concept and nature of them,and the approach of rule-based governance over the Party.However,there are clear traces of theoretical transplant in their research.The dispute over the nature of inner-Party laws and regulations runs through the entire study.We should carefully review the development of inner-Party laws and regulations,correctly understand the nature of them,and combine them with the principle of the rule of law,so as to establish the theory of inner-Party laws and regulations,which is in line with the reality of the Party and the state.
