诊所式法律教育与法律人的培养

Clinical Legal Education & Cultivation of Legal Professionals

20世纪60年代在美国法学院兴起的诊所式法律教育以职业技能的训练、职业道德的训练、促进社会的正义为目标,将理论与实践完美结合,可以弥补目前我国高等法学教育体系在培养法律人方面的不足。但是,采用何种法学教育模式,受到法律传统和文化传统的约束。因此,从国外移植诊所式法律教育的同时,必须结合我国法学教育传统、现行制度以及客观条件的现实,经过不断地调适和整合,才能建立起科学的法学教学方法体系,做到传统教育与现代教育的完美结合。

Clinical legal education,which sprang up in the United States in the sixties of 20th century,focuses on training of professional ability,cultivation of professional ethics and promotion of social justice.By means of integration of theories and practice in the training of legal professionals,clinical legal education can serve as a remedy for the defects in current legal education system in China.Nevertheless,the adoption of legal education mode is subject to legal and cultural traditions.Therefore,in the transplantation of clinical legal education to China,some essentials should be taken into consideration including legal education traditions in China,current systems and conditions.Only after a constant adaptation and integration,can we construct a scientific system of legal education,and achieve a perfect integration of tradition and modern education.
