论绿色发展理念对生态文明建设的价值引导——以公众参与制度为例的剖析

On the Value Guidance of Green Development Concept to Ecological Civilization Construction——Analysis of Public Participation System as an Example

根据绿色发展理念的要求和法治建设的基本原理,可以从四个方面完善生态文明建设的公众参与制度:一是凸显价值引导,即推动绿色发展理念制度化,对接公众利益和日常行为;二是强化行政执法,即完善公众参与的程序,明确政府的责任;三是健全司法体制,即大力发展公益诉讼,建立专门的生态审判机构;四是完善立法内容,即关注细微问题,并把公众参与扩大到一切生态法律制度中。

According to the requirement of green development concept and the basic principle of construction of rule of law, we can consummate the legal system of public participation in ecological civilization construction in four aspects: The first is to highlight the value guidance, which means that we should promote the institutionalization of green development concept, and make it butt with public interest and daily behaviors. The second is to strengthen administrative law enforcement, which means that we should consummate the procedures of public participation, and clarify the responsibility of the government. The third is to improve the judicial system, which means that we should strive to develop the public interest litigation, and set up special ecological judicial organs. The fourth is to improve the legislative content, which means that we should pay close attention to details, and enlarge the public participation to all the ecological legal systems.
