网络环境下广播组织权利内容立法的反思与重构——以“修正的信号说”为基础

The Reflection and Reconstruction of the Legislation on Broadcaster’s Rights——On the basis of the revised Signal-based approach

关于广播组织权利内容的构建,理论上存在严重的分歧。"节目说"理论主张以保护广播节目内容为基础构建广播组织的权利内容,"信号说"理论主张仅保护广播组织对广播信号的即时利用的控制权,"邻接权说"理论主张以邻接权制度来保护广播,上述理论均存在一定的缺陷。我国应以"修正的信号说"理论为基础构建广播组织权利内容,保护广播组织对广播信号即时利用和后续利用的控制权。我国《著作权法》修订时应根据本国国情及新技术发展的要求对转播权、录制权和复制权的规定进行完善,同时增加有关发行权和网络传播权的规定,暂缓规定重播权和向公众传播权,并保留广播组织权利的保护期限的规定。

In order to protect the broadcaster’s rights, there are different solutions. Some advocate establishing the broadcaster’s rights through a Content-based approach. Some support constructing the broadcaster’s rights by a Signal-based approach, Other regard the broadcaster’s rights as related rights. Such view is imperfect. We should build the broadcaster’s rights on the basis of the revised Signal-based approach, because it is necessary to provide the broadcasting organizations with rights of controlling the immediate use and subsequent use of broadcast signals. When amending the Chinese Copyright Law, it is important to perfect the provisions of right of retransmission, right of fixation and right of reproduction, to increase the provisions of right of distribution, right of network communication of the broadcast fixation, and to suspend the provisions of right of rebroadcasting and right of communication to the public, as well as to reserve the duration of protection provision of the broadcaster’s rights.
