农村集体建设用地流转制度的创建及相关问题的思考

Establishment on the moving system of collective construction land in countryside and the related problems

在对中国农村集体建设用地产权制度的欠缺及其入市流转的法律缺陷等问题分析基础上 ,针对集体建设用地流转 ,提出完善现行相关法律、法规的创新空间 ;根据全国各地试点经验的总结 ,进一步设计出集体建设用地的流转制度 ;最后 ,对集体建设用地入市流转在目前所涉及的若干重大和现实问题进行了讨论 ,认为该制度的创建和实施在目前主要应考虑集体土地产权制度建设 ,农民土地财产权的保护 ,入市流转的基本原则 ,流转的法律保障以及对当前征地制度改革的影响等问题。

On the basis of analyzing the weakness of the property right in collective construction land in countryside and the legislative shortage of its transformation,the creative thought path of the current related law is suggested according to the transformation of collective construction land in countryside.Then,a new system of the transformation system of collective construction land is designed according to the experiences of experimental units over the country.At last,several important existed problems of transformation system of collective construction land are discussed.It indicates that the construction of the property system of the collective land,the conservation of farmers land property,the basic principle of transformation system,the legistic protection of the transformation,the land requisition system should be considered in the process of the implementation and establishment of this system.
