摘要
大数据已经开始影响我们生活的方方面面。大数据及其应用的迅速发展,也引起了法律界的关注。本文以大数据在法律领域应用的风险为切入点,分别从立法角度、法律预测、执法三个层面探讨可能存在的风险。在探究过程中,本文采用Berring定义的法律分析研究方法,分三个步骤对大数据在法律领域应用时可能产生的风险问题进行探讨,并且提出法律层面的解决思路。
Nowadays, it is undeniable that big data is affecting many aspects of our daily life. Also in the legal field, much attention has been drawn due to the rapid development of big data and its implementation. Lawyers are researching and discussing this great change from various legal perspectives. In this context, the starting point of the research is to examine the risk of implementing big data in the legal field, and probing into the possible risks from the perspective of legislation, law prediction and law enforcement respectively. In the process of researching, this paper utilizes the methodology of legal analysis defined by Berring, through three steps to examine the risks, and puts forward the legallevel solution as well.
