利益衡量又称利益平衡,它和价值衡量密切相关,可分为法律制度层面的利益衡量和司法层面的利益衡量,民法即是一门利益衡量的艺术和学问,其目标指向正义。同时,民法中的利益衡量又须遵循相应规则,以避免主观、随意而达到客观、科学化的目标。
