上海市民办幼儿园依法处理校园伤害事故的现状研究

A Survey of Handling Safety Accidents in Private Kindergartens in Shanghai

本研究围绕校园安全这一社会热点问题,对上海市民办幼儿园依法处理校园伤害事故的现状进行了研究,结果显示:(1)民办幼儿园管理者对现行法律法规的了解存在一定的不足。(2)民办幼儿园的校园安全管理工作存在漏洞,校园安全事故时有发生。(3)责任认定是当前校园伤害事故处理中的难点。(4)当事双方自行协商解决仍是校园伤害事故处理的首选途径。根据本研究的结果,我们建议民办幼儿园从加强相关法律法规的学习、加强安全自律意识、抓紧制定并完善园内各项安全制度、加强全园保教人员的安全专题培训、完善本园的保险保障制度等多方面着手,努力为广大幼儿创设一个安全、健康的学习生活环境。

The survey tried to study the handling of safety accidents in private kindergartens in Shanghai,and the results showed that(1) managers had only limited amount of knowledge about the laws;(2) loopholes in management of private kindergartens led to frequent occurrence of accidents;(3) responsibility attribution was the biggest challenge in handling the accidents;(4) negotiation between interest parties remained the preferred way.In view of the findings,we suggest the private kindergartens enhance law and security study,the awareness of safety,perfect the security rules as well as insurance system to create a safer and healthier environment for children.
