商事仲裁机构在仲裁服务市场中的竞争具有客观必然性。虽然目前商事仲裁机构的竞争存在诸多体制和机制上的不足和障碍,仲裁机构竞争意识不足,仲裁服务市场整体上竞争不足,但仲裁服务市场竞争已呈日趋激烈的态势。国家应顺应仲裁服务市场发展的需要及时修订仲裁法,改善仲裁机构竞争之外部环境。而商事仲裁机构应审时度势,完善治理结构,建立一支富有竞争力的仲裁服务队伍,提高综合竞争能力。

The competition between the Commercial Arbitration Organizations on the arbitration service is necessity in China.Although there are many shortcomings and obstacles of the system and mechanism exist in the competition,the insufficient competitive consciousness,the insufficient competition on the Arbitration Service Sector,the competition of Arbitration Service Sector has shown an increasing trend.To meet the demand of the Arbitration Service Sector's development,the government should amend the'Arbitration Law'to improve competition's external environment.Meanwhile, Commercial Arbitration Organizations should valuate the situation,and establish a competitive contingent of arbitration services.
