在线仲裁是处理电子商务纠纷最好的争议解决机制之一。然而采用仲裁方式在线处理纠纷时,对事实的判断和认定,就必须适用或依靠电子数据。但目前,我国在电子证据方面的立法还相对滞后,实践中运用电子证据的规则也不一。因此本文拟就在线仲裁适用电子证据方面的规则,包括电子证据的证明力,电子证据的收集、利用等问题作一探讨。

On-line arbitration is the best one of the settlements of E-commerce disputes.And the electronic evidence must be adopted in the process to judge and recognize the case facts.But current legislation of the electronic evidence can not meet the demand of practice and people has different opinions on the evidence adoption rules.So this article discusses the topics such as the the power of electronic evidence,the collection and adoption of them.
