摘要
2003年《农村土地承包法》颁布,第一次明确提出将仲裁作为一种重要的农村土地承包纠纷的解决途径。本文通过对我国拟建立农村土地承包纠纷仲裁制度的特征、性质、必要性、弊端,以及与普通民商事仲裁关系的研究和探讨,提出了我国现阶段完善农村土地承包纠纷仲裁制度的一些建议。
The Rural Land Contract Law of 2003 stipulates arbitration as an important resolution system of land-contracted dispute in rural area.This article discusses the trait and nature of the would- be arbitration system of land-contracted dispute,and the need and disadvantage of this system,and also its relationship with general arbitration of civil and commercial cases.This article also puts forward some suggestion on how to complete the arbitration system of land-contracted dispute under current circumstance.
