农村土地承包纠纷仲裁制度研究——构建和谐社会的抉择

The Research on Arbitration System of Land-Contracted Dispute

构建社会主义和谐社会、建设社会主义法治国家的重要保证正是合理有效地解决日益复杂的纠纷。土地承包纠纷因其自身的重要性急需稳妥解决,土地承包仲裁机制应运而生并迅速发展,但其置于行政范畴下,在理论与实践中却出现了不少问题。本文通过对土地承包纠纷特点的分析,对比诉讼与仲裁两种纠纷解决方式,以期在民商事仲裁体系框架下,以和谐社会为视角重新建构完善农村土地承包纠纷仲裁制度。

Dispute and harmony are inseparable and controversially unified.The significant guarantee to constitute a harmonious socialist society and construct a socialist legal state is to solve the present increasingly complicated disputes reasonably and effectively.The land-contracted dispute,due to its inherent significance,in great need of immediate solutions gives birth to the arbitration system of land contract.However,there come lots of problems both in theory and practice.By analyzing the characteristics of arbitration system of land-contracted dispute and comparing litigation and arbitration to solve the land-contracted dispute,upon the legislation and practice of land contract,this thesis is in expect of constructing to perfected arbitration system of land-contracted dispute.
