(接第十四辑)……三、国际体育仲裁司法监督之实践考察(一)国际体育仲裁司法监督的体系构造前文已述,体育仲裁的司法监督乃是国家通过法院对仲裁施以审查的方式来达到支持其发展,并进而推动体育事业发展的目的。笔者以为,法院之于体育仲裁的监督,理应为从体育仲裁之协议,经由体育仲裁之程序,直至体育仲裁之裁决的全方位监督与协助。缘此。
The sports arbitration serves as a alternative dispute resolution in sports area.The judicial supervision on sports arbitration is based on its nongovernmental nature.Nevertheless,the essence,character,and value of sports arbitration strongly sustain the conclusion that the judicial supervision should be narrowed down to the extent of procedural matters.What's more,the courts also follow the principle in practice.The judicature cooperates perfectly to the autonomy of sports area.On this perspective,the theory and practice of judicial supervision to sports arbitration hold important significance to international commercial arbitration.
