Analysis on the Financial Arbitration in Setting Financial Disputes

金融仲裁是根据金融纠纷的特点所设计的一种争议解决方式。仲裁制度不同于诉讼和劳动仲裁,并且在金融仲裁制度中仲裁员的专业性、程序的高效性、费用的经济性、执行的广泛性等特点对于解决金融纠纷更有独到的优势,对金融仲裁的发展有极大的促进作用。同时,本文针对金融仲裁本身的局限性也作了客观分析并提出了改善建议。

Financial arbitration is designed to be a special means to solve financial disputes. Arbitration system is different from litigation and labour arbitration.The financial arbitration system, which characterizing in professionalism of arbitrators,high efficiency of arbitration procedure,lower costs of arbitration fees and international recognition of enforceability of awards,gains unique advantages in settling financial disputes comparing with other methods of disputes resolution.These characters help to further the development of financial arbitration.However,there are disadvantages and limitations in the financial arbitration system.Some objective analyses and proposed improvements are also given in the essay.
