域外仲裁证据的认定,在仲裁程序解决民商事纠纷的过程中发挥着重要的作用。本文作者以仲裁程序中域外证据认定冲突现状为出发点,从域外仲裁证据的界定和认定模式类型化的角度重新审视了域外仲裁证据的认定机制,进而提出了域外仲裁证据认定制度构建之设想。

The adoption of the arbitral foreign evidence plays an important role in the arbitration process of settling commercial disputes.The author of this article makes the starting point at the conflict situation of adopting the arbitral foreign evidence in arbitration process;analyze the mechanisms of adopting the arbitral foreign evidence from two points of view,including the definition of the arbitral foreign evidence and its adoption classification,then propose some suggestions for the mechanisms of adopting the arbitral foreign evidence.
