仲裁协议效力扩张问题,在国内外商事仲裁理论和实践中一直存在争议。尤其在1958年《承认与执行仲裁裁决效力公约》(以下简称《纽约公约》)中体现出尽可能认定仲裁协议有效的精神,以及各国立法和仲裁司法实践中,对仲裁协议书面形式要求的日益放松,加之各国在实际案例中对商事仲裁协议效力扩张的认可和接受,使仲裁协议效力扩张从理论走向实践,逐渐成为一种被各国所接受并逐渐被应用的一种仲裁司法实践。面对仲裁理论与实践中逐渐成熟并被应用的一种仲裁司法实践,本文试图在《纽约公约》的基础之上,结合多国较先进的仲裁立法和实践,探讨仲裁协议效力扩张逐渐成形的一些主要表现形式,并结合一些实际案例,分析这些具体表现形式的理论基础和实践基础,以及它们在实际运作中可能会产生的问题,以期对商事仲裁协议效力的扩张有更加理性和客观的认识,并且试图通过对仲裁协议效力扩张具体表现形式问题的探讨,让人们在适用仲裁效力扩张的过程中注意这些具体形式适用的限制和边线。

There are some disputes in domestic and foreign arbitration law of the expansion of the effectiveness of the arbitration agreement.In particular,when'the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards'(hereinafter referred to as'New York Convention') in 1958 shows the spirit of supporting the effectiveness of the arbitration agreement,as well as national legislation and judicial practice of relaxing the form of arbitration agreement,the expansion of the effectiveness of the arbitration agreement has been admitted and accepted from theory to practice,and gradually accepted by many countries' arbitration judicial practice.This thesis attempts to explore the expansion of the effectiveness of the arbitration agreement' s main manifestations on the basis of'New York Convention',combine with the more advanced multinational arbitration legislation and practice,to analyze these main manifestations of the theoretical foundation and practical basis,as well as their actual operation,and aim to have a more rational and objective understanding of the expansion of the effectiveness of the arbitration agreement.
