中国承认与执行外国仲裁裁决的发展展望——从第一例承认与执行在中国做出的外国仲裁裁决谈起

The Development and Prospect of Recognition and Enforcement of Foreign Arbitral Awards in China——From the perspective of the first case of recognition and enforcement of China-seated foreign arbitral awards

浙江省宁波市中级人民法院做出了第一例承认和执行在中国内地做出的外国仲裁裁决的民事裁定,受到了业界的普遍关注。本文集中讨论了国际商会仲裁院能否在中国内地仲裁,国际商会仲裁院在中国内地仲裁是否属于临时仲裁,是否应当承认和执行在中国内地做出的国际商会仲裁裁决三个问题。本文主张展望中国承认与执行外国仲裁裁决的发展,中国仲裁立法应在承认临时仲裁和建立非内国裁决标准这两方面有新的突破。

Zhejiang Ningbo Intermediate People's Court recently handed down a high profile civil decision,the first case ever in China's Mainland,recognizing and enforcing a foreign arbitral award issued by a foreign tribunal seated in China's Mainland.This article specifically deals with three issues related to the ICC arbitrations awards:(1) Whether ICC arbitration can be legally conducted(or ICC tribunal can be legally seated) in China's Mainland;(2) Whether ICC arbitration seated in China's Mainland is an interim arbitration;(3) Whether ICC awards should be recognized and enforced in China's Mainland.This article presents a vision of the general recognition and enforcement of foreign arbitral awards in China's Mainland,and expresses the necessity for a legislative breakthrough that will legalize the recognition of interim arbitration and establish a clear definition of non-domestic arbitration.
