摘要
对于法律统一解释,全国人大常委会仅仅关注刑法,而民法、行政法的统一解释仍交由其他机构和部门。全国人大常委会法制工作委员会在现实中起到了一个常设法律解释机构的作用,这种法律解释模式更多是应因法治需要而采取的便宜之计,在中国法治向纵深发展时,我们可能需要对法律解释体制作一个全面、理性的重构。
The NPC standing committee merely interprets criminal law,the interpretations of civil law and administrative law are made by other departments and organizations.The Legislative Affairs Commission of the NPC standing committee practically is a standing organization taking charge interpreting laws.The mode of system of interpreting laws is a lash-up method.When nomocracy develop deeply in our country,we must produce a new system of interpreting laws.
