Debt Contract,Checkup Cost and Cost-saving Institutions

在签订债务合约时,对债务人偿付能力以及偿付意愿进行核实是债权人必须从事的一项工作。然而这项工作又是需要花费成本的。在不损害信息质量的前提下,任何一种能够节约这些核实成本的机制,都会有利于交易者之间的合作。在本文中,我们将探讨债权人核实工作的一些基本内容和特点,同时我们也将分别列举和论述能够部分节约这些核实费用的机制,以及这些机制是怎样节约核实成本的。这些机制包括抵押、声誉机制、审计制度、债权人持股、两权分离制度以及信息公开制度等等。

Before signing the debt contract,the creditor must check the debtor's capability and willingness to pay back.However,such a work is a money-consu- ming affair.So any institutions that can save the checkup cost without reducing the quality of information are propitious to cooperation between the negotiators.In this paper,we will discuss some essential contents and characteristics of creditor's check work,and we will also enumerate and analyze some cost-saving institutions, which including Mortgage,Reputation,Audit System,Creditor Holding Stock, Separation of ownership and control,and Open Information System,and the way how these institutions work
