摘要
本文试图明确社会契约论、新旧制度经济学和法律政治理论等相关领域中关于契约概念的共同内涵,将契约定义为行为规则,接着给出规则即契约的三种生成机制及其相应的规则类型、形式和特征,而混合机制则导致规则系统及其层次,由此形成契约社会。
This paper wants to make clear the public definition of the concept of contract among the relative fields such as social contracts theory,new and old in- stitutions economics,law and political theory.It defines the contracts as rules of behaviour,then presents three production mechanisms of rules,i.e.,contracts, and the correspond types,forms and features of rules.The mixed mechanisms will give rise to the system and hierarchy of rules.Contractual society forms thereby.
