The Evolution of Economic Analysis of Law and Change of the Implication of Economics of Law——An Example of Economic Analysis of Self-help Remedies

本文以"私力救济"的经济学分析为例,探讨了法律问题的经济学分析方法从新古典的供求分析、交易成本经济学,到制度设计等的演进过程。法律问题的经济学分析方法演进过程表明,法律经济学的内涵经历了从法和经济学到法律的经济分析的过渡,并随着制度设计理论的成熟而最终演变为法律经济学。

This paper discusses the evolution process of approach of economic analysis from neoclassical analysis of supply and demand,Transaction Cost Eco- nomics to institution design with economic analysis of self-help Remedies as an ex- ample.The evolution process shows that the implication of Economics of Law expe- rience the change from Law and Economics to Economic Analysis of Law,eventu- ally Economics of Law accompanied by the development of the theory of institution design.
