摘要
本文通过确认纠纷解决机制的公共产品属性,从经济层面阐述了纠纷解决机制两个组成部分ADR与诉讼的互动态势。说明了缺失ADR时的诉讼垄断下的社会福利损失,并由此判断出ADR存在的价格空间。同时,就二者的过度价格战和消极竞争也分别做了阐明。
In the view of the public good character of the disputes resolution system's,we can expound the relations of the ADR and the litigations that com- posed the above system,and also analyse the welfare lost in the monopolization of litigations and the price space of the ADR in existence,and explain their excess price war and the negative competition.
