摘要
小区业主和车库的主人围绕共有部分的权利、义务,因物权法的规定变得模糊起来,不但不能"定份止争",反而混淆了归属,为今后诱发费用冲突埋下隐患。为解释这一逻辑矛盾和潜在利益冲突,本文引入奥地利学派的主观知识理论,尝试运用个体间主观知识差异及其协调来解释中国正式法律制度变迁过程中的条款矛盾和蕴藏的利益冲突。分析结论表明,颁布的法律条款可能处于"当事人之间未形成共同知识"的非均衡状态。
The equity ownership,obligations of community residential owners and garage owners will be confused because of the Real Right Law of the People's Republic of China,which is not only to'set in the conflicts',but also to con- fuse the Property Rights,it has planted the seeds of hidden problems because of the future cost-induced conflicts.In order to explain these logic contradictories and potential benefit conflicts.This paper introduces the'subjective knowledge'theory of Austrian School,and tries to explain whether contradictories and conflicts go with the possession of legal system Transition is a universal phenomenon in China from the view of different individual subjective knowledge and coordination between individuals.
