专利许可、专利联盟中的反垄断诉讼及其经济分析——兼从欧美的司法实践谈我国目前的对策

Patent Licensing,Patent Pool and Anti-Trust Litigation with an Economic Analysis

知识产权保护和与知识产权相关的垄断行为已成为人们关注的话题。本文通过对知识产权法与反垄断法之间关系的阐述和对欧美在知识产权反垄断案例评述的基础上,着重应用微观经济学原理,对垂直型、水平型许可、交叉许可和专利联盟进行经济分析和法律评价,认为在水平型许可、交叉许可以及专利联盟中可能存在滥用市场优势地位而违反了竞争法。本文还对欧美知识产权法和反垄断法的新发展,特别是对改革方面的诉求进行评析。此外,对和中国有关的专利案件也进行了简要评述。

The issue of protection of intellectual property right and the related abuse of dominant position has become a disputable topic which attracts public de- bate.This article intends to analyze the relationship between intellectual property protection and antitrust practice with microeconomic tools.Specifically,this article will analyze how and under what conditions will vertical licensing,horizontal li- censing or cross licensing be regarded as antitrust practices.Furthermore,the arti- cle will introduce the latest development in the U.S.and EU with respect to intel- lectual property litigation in antitrust,as well as the desire for reform in this field.Additionally,a brief comment is made on the China-related patent cases.
