摘要
群租问题是制约我国城市发展、社会稳定的重要问题,当前我国法律文件中对群租尚没有明确定义。从建筑物区分所有权、相邻关系、民事责任的角度对其进行分析,可以得出房屋出租人享有群租权,但不得滥用其权利损害周边业主的利益。治理群租问题,最有效的法律方法是采用私法调整的措施,并以公法规制手段予以配合。
The problem of group of rent is an important issue that restricts our urban development and stability of society.Presently,Chinese laws have not defined the concept of group of rent. We analyze the problem form three points of view which include Apartment Ownership,Adjacent Relations, Civil Liability,and we can draw a conclusion that lassoers enjoy the right of group of rent,but they should not abuse the right to damage the benefits of the surrounding owners.The most effective method of law to manage the problem of group of rent is the measure of private adjustment,to cooperate with the method of the regulation of public law.
