摘要
台湾地区对现行《涉外民事法律适用法》的最新修正是台湾地区为实现其国际私法立法现代化目标的结果。台湾地区此次修法不仅体现在立法形式上的现代化,更体现在实质内容上的现代化,并呈现出与各国国际私法立法普遍实践的趋同。但此次修法并非完美无瑕,仍存一些不足需待改进。
The latest Amendment of Law of the Application of Law for Foreign-related Civil is the result of Taiwan Region realizing the modernization of legislation goal of private international law. The revision of actual law by the Amendment is carried out in two respects, one the modernization of the legislation form, the other the modernization of substance. The Amendment showed the convergence of the legislation between Taiwan and other country. But The Amendment is not perfect, and is necessary to be improved.
