科学发展观视野下的司法独立——以审判权的独立为视角

A Study of the System Agreement about the Judiciary Independence and Scientific Development Concept——Taking the Independence of Trial Power as an Angle of View

司法独立体系的建构必须要体现科学发展观的要求,要随着社会发展的步伐不断进步,要把以人为本作为建构司法独立体系的核心要求,同时在法制建设的同时要满足可持续发展的要求。我国现阶段司法独立体系的建设已经取得长足的进步,但是在我国司法实践中,司法独立遇到的现实冲突还是不少的,本文拟从法官、机构设置等角度探讨我国司法独立体系的建构。

The construction of judiciary independence in our country must embody the need of the scientific development concept. It should be reformed step by step with the social development, and made person-orientedness the nuclear of the construction of judiciary independence. Meanwhile, the development of the law system should satisfy the request of the scientific development concept. The construction of judiciary independence in our country has developed fast in recent years, however, the conflicts between the judiciary independence and the reality are very common in practice. This paper will study the construction of judiciary independence in view of the judges,the establishment of organization and so on.
