中国古代法理学不发达的原因及其启示——法社会学视角下的省思

On the Reason and Illumination of the Undevelopment of the Jurisprudence in Ancient China

中国古代法理学的研究起步甚早,但是却未能发展成专门的学科,远不如西方发达。其原因是复杂的,包括独特的社会结构、法律教育模式的缺陷、职业共同体的缺失、法律职业者的地位过低以及独特的历史文化等多个方面。而部分制约古代法理学发展的关键因素在今天仍然存在,这对当下中国法理学研究仍有警示和借鉴意义。

The study of Jurisprudence in ancient China started very early and achieved a high level.But it failed to develop to a specialized academic subject.The reasons are complex,including the unique social structure,the impact of Confucian idea,the defect of the system of legal education,the lack of professional community,the legal profession's low status and unique history and culture.The study of these issues can benefit the development of current Jurisprudence study by giving warning and illumination.
