论刑法因果关系理论的哲学迷思及其出路

Research on the Reflection and Improvement of the Causal Relationship in Criminal Law

刑法因果关系不但是刑法学中的一个重要的理论问题,在司法实践中也具有极其重要的意义。我国大陆刑法因果关系理论仅在哲学层面陷入哲学迷思,使得我国刑法因果关系处于理论困境,难以摆脱。我们应转换视角,用新的视角对我国大陆刑法因果关系理论进行新的探究,使刑法因果关系理论得以走出困境。

The theory of causation is an important problem in the field of Criminal Law,and it is also of importance in judicial practice.However,we only research on the causation in the philosophical aspects of the theory around the philosophical question whether the causation is 'inevitability' or 'accidental'.Then it is lost in the myth of philosophy,and the causal relationship in criminal law is also lost in the plight of the theory and difficult to shake off.We should convert perspectives,use a new perspective to research on the causal relationship in Criminal Law,and then improve the theory of the causal relationship in Criminal Law.
