交通产业法基本原则贯穿于交通产业法的始终,对规范交通产业有根本指导作用,也是构建交通产业法体系的重要前提。本文正是从各个不同学理视角分析交通产业法的基本原则,确定了市场导向与国家干预相结合原则、经济合法原则、可持续发展原则三项交通产业法的公有原则,优化产业结构、因时因地制宜原则、鼓励科技创新原则三项交通产业法的特有原则,以求能为制定交通产业法提供学理上的支撑。

The basic principles of transportation industry law which has a fundamental guiding role in regulating transportation industry, always penetrate the transportation industry law, and are the premise for transportation industry law system. From the perspective of the various theory, this article analyzes the basic principles of transportation industrial law, establishing three public principles: market-oriented with the combination of state intervention principle, economic and legal principle, and sustainable development principle; establishing three unique principles: the principle of optimizing the industrial structure, the principle of according local conditions and local place, and the principle of encouraging technological innovation, so as to provide doctrinal support for the development of transportation industry law.
