村庄社会秩序的调停者——基于一项民事纠纷的社会学考察

The Mediator Social Order in Village: Based on a Sociological Study of Civil Disputes

通过呈现一件民事纠纷的一些主要特点和片段化的场面来表达当前弱者维权的全景式画面,通过引入第三类人这个关键的概念和学术表达来揭示整个维权过程的动态特征,在借鉴现有的大量学术研究成果的基础上,该文的研究目的有二,首先仍然是采用情景式的学术语言和微观的场面来表现维权过程的各个部分;其次,长期以来,学术界和理论界的目光都是集中在城市和热点的维权声音,对于乡村的的维权机制的关注明显很少,目前传统的乡村显然正处在一个最激烈的变迁之际,这不仅体现在宏观的社会结构方面,也体现在日常的微观实践行为。

By presenting some key features of a civil dispute and clips of the scene to express the panoramic screen of the rights of the weak in the current, by introducing the third category and its academic expression to reveal the dynamic characteristics of the whole process of right protection, based on the results of the good number of the existing academic researches, this study has two purposes: the first is to display each part of the process of the right protection by using situational academic language and micro-scenes; second, for a long time, the attention of academics and theorists are mainly concentrated on cities and hot spots while little on rights protection mechanisms in villages, and the current traditional villages are in fierce transition, not only in the macro-social structure, but also in micro-behaviors in daily practices.
