市场经济法律是市场经济的构成性规则。它不应该也不可能外生于主权者的主观意志 ,只能内生于客观的市场经济规律 ,前者意味着限制市场的作用 ,后者则让市场充分发挥作用。市场经济的法律并不仅仅指一种法律制度 ,而且更代表一种法治的精神 ,其包含的价值追求是它最重要的因素。秩序、平等、自由和效益完美结合的市场经济价值观 ,是市场经济发展规律的体现 。

The market economy law is the constitutive regulation of market economy. It should not and could not grow aside the subjective volition of sovereignty, but grow inside external market economy rule. The former means restricting the action of market, while the latter bring into full play the action of market. The law of market economy is not only a kind law system, and furthermore,it contains the most important factor. The market economy value that combines the order, equality, freedom and benefit faultlessly is the embodiment of market economy evolution rule, and is the major idea of law-government.
