摘要
正当防卫是法律赋予公民的一项重要权利 ,是鼓励和保障公民同违法犯罪行为作斗争的重要法律武器。研究正当防卫的适用条件 ,是为了准确理解和把握正当防卫 ,对于公民正确适用正当防卫 ,维护和保障国家、公共利益和公民的合法权益 ,威慑犯罪分子 ,制止和预防犯罪 。
Ligitimate defence is an important citizen right awarded by law.As an necessary legal weapon legitimate defence encourages and ensures a citizen to fight against criminal activities.The positive significance is obvious when we research on suitable prerequisite of legitimate defence ,comprehend it correctly and make it certain. All these lie in citizens’ correct adoption of it to safeguard and ensure social interests and the legal rights of citizens, intimidate criminals, and prevent and guard against criminal activities.
