完善网络刑事立法的焦点问题

日益猖獗的网络犯罪已经引起政府、社会各界和广大公民的高度关注,但我国现行法律制度在应对网络犯罪问题时表现出许多缺陷和不足,如可适用的法律规范不足、法规的可操作性差、打击力度偏轻等等。因此,必须从法律体系、证据制度以及对电子商务、网络个人资料和网络知识产权的特别保护等角度完善我国网络安全刑事立法。

The government,societies and people have paid high attentions to the increasing internet crimes, but our current legal systems have showed many defects when facing the internet crimes, for example, we lack rules to apply, the rules of laws are not so good to be operated, the forces of crack down on the internet crimes are weak, etc. So, the following practical angles should be thought of to perfect the criminal legislations about internet safety, including legal systems,evidence systems,special protections on electronic business,private internet information and internet intellectual property, and so on.
