论环境法的调整对象

On Regulating Object of Environmental Law

按照传统的法学观点 ,制定和实施环境法的目的是为了利用环境的外在价值 ,确认和保护人类自身的利益 ,因此 ,环境法的调整对象只能是人与人之间关于环境的社会关系。但是 ,环境的内在和外在价值是统一的 ,两者存在共损共荣的关系。承认和保护环境的内在价值对于保护人类自身的利益、维护其他物种在自然法则面前的平衡发展是非常必要的。人类作为地球上唯一具有理性思维的人应该用法律来确认和保护这种价值。用法律来确认和保护这种价值的最好方法是承认环境法可以调整人与环境的关系。

According to traditional juristic viewpoint,the aim of making and implementing environmental law is to use external value of environment,to affirm and protect benefits of mankind.So the regulating object is only social environmental relation among people.But external value and inherent value of environment are uniform.The relation of harming together and developing together exists between them.In the aim of protecting benefits of mankind and maintaining other species' balanceable development in the presence of law of nature.It's very necessary to admit and protect this inherent value.As a exclusive species that has rational thinking on the earth,mankind should affirm and protect this value.The best way is to admit that environmental law can regulate relation between mankind and environment.In this article,the author demonstrates this proposition elaborately from the angle of Marxism law theory,legal provision,function of environmental law,practical effect of environment,object of environment legal relation,the character of environment legal norm and the practical legislation.
