Some Notes on Hayek's Theoretical Framework

本文将着重讨论哈耶克在建构其法律理论和政治理论的过程中所提出的几个重要问题：“社会秩序分类学”的建构；“行动结构与规则系统”框架的确立；“三分观”的确立与“文化进化”命题的阐发；从“无限民主”的批判到“有限民主”的确立；对社会正义的批判与否定性正义的确立；从欧洲大陆法治国向普通法法治国的转换；关于自由主义与非西方或发展中国家间关系的讨论等等。

This paper is an intensive study of some basic concepts which Hayek puts forth in his theorization of legislature and politics. They include the categorization of social outer, the structure of action and the system of rules, the tripartite view and cultural evolution, limited democracy vs. unlimited democracy, the critique of social justice and the establishment of negative justice, the shift from the continental law to the common law, the relationship between liberalism and the developing countries, etc.
