Infringement and the Transitional Order

通过对体制转轨过程中违规行为的特质进行分析,可以发现在中国现行体制下违规行为存在的深刻必然性。其关键是所违之规是计划经济之规还是市场经济之规,这种制度规则是不是各方利益的均衡点。违规构成中国转轨秩序的基本特色。它是计划经济和市场经济相互作用的产物。违规既是市场经济冲破旧体制的手段,又是旧体制“扼杀”市场经济的根据。

Through analysis of nature of the infringement in transition of systems ,This paper point out that the infringement has necessity.The key question is whether the rules are ones of market economy or ones of planning economy ,and the rules are the balance of interests or not.Infringement is the basic characteristic of the transitional orders of China,and is the outcome that planning economy and market economy act on each other.The infringement is not only the means by which market economy breaks through the old system,but also the grounds on which the old system strangles market economy.
