中小银行法律风险管理机制建设研究

Research on the Construction of Risk Management Mechanism to the Small and Medium-sized Banks

经济新常态下,金融风险事件不断涌现,银行经营风险加剧、竞争压力持续加大。中小银行不但资产总额小、人员配备少、风险抵御能力弱,而且法律风险管理起步较晚,因此其法律风险管理形势更为严峻。本文从风险来源将法律风险划分为内生法律风险和外生法律风险,并试图提出中小银行法律风险管理机制建设的相关建议。

Under the new normal of China’s economy,financial events constantly emerge,the risks of bank man?agement intensify,competitive pressures continue to increase. The characteristic of small and medium-sized banks aresmall size asset,less staffing,weak risk resistance and the late starting management of legal risk,and the situation ofthe legal risk management is more serious. In this paper,from the perspective of risk source,the author divided the le?gal risk into endogenous risk and exogenous risk,and tried to put forward legal suggestions for the construction of riskmanagement mechanism to the small and medium-sized banks.
