Study on Importance of Clear Expression of Design's Diagram from the Perspective of Invalidation Review

视图作为外观设计专利最重要的有效记载文件,视图是否能够清楚表达要求保护的外观设计直接影响到专利权的稳定性。本文将从复审无效案例入手,反观视图清楚表达的标准,并针对部分典型案例给出建议。

Diagram is the most important records stating the validity of design patent. The diagram is unable to define the protection scope of a piece of design clearly will challe-nge the validity of patent. This paper will study the invalidation review cases in order to scrutinize the criterion of the clear expression of design’s diagram, and will make some advises based on some typical cases.
