作为试管婴儿技术的延伸,试管婴儿代孕虽为我国现行法律所禁止,但在现实中却屡见不鲜,由其引发的一系列法律问题也逐渐引起了人们的关注和思考。本文针对试管婴儿代孕引起的试管婴儿父母,尤其是代孕母亲身份的认定及权益保护的法律问题进行探讨。

As an extension of the test tube baby technology, test tube baby surrogate is prohibited by the current law of our country but it is very common in reality.A series of legal problems caused by it has gradually aroused people's attention and thinking.In this paper,the identification and protection of the rights and interests of the test tube baby,especially the surrogate mother are discussed.
