微信公众平台中的著作权维权研究

A Study on Copyright Protection in WeChat Public Platform

在微信公众平台运营的过程中,抄袭行为或者未经著作权人授权的上传和转载行为,可能会涉及到侵犯著作权人的权利。微信公众平台的受众范围有限,这使得其传播途径具有更强的私密性和受众的特定性,也导致原创者或权利人在不关注某公众平台的情况下,如果不借助技术手段,很难发现自己的权利遭受损害的事实,从而引发了"发现难"和"维权难"的问题。建立具体的微信著作权立法保护体系,规制、完善第三方维权组织,在行业内部建立纠纷调解机制,将会有利于微信平台上的著作权保护,快速地处理著作权纠纷。

Copying, uploading or reproducing others’articles without author’s agreement in WeChat public platform may violate the authors’ copyrights. Because there is only limited audience in WeChat public platform, its transmission routes need much more confidentiality and have specific audience. So if originators or right holders didn’t follow some public platforms, they will not easily find their rights violation without the support of relevant technology, which will cause problems of“difficult to notice the violation”and“difficult to protect rights”. In this condition, building specific legal WeChat copyright protection system, regulating and perfecting organizations of the third party and setting up internal conflict resolution mechanism will help to protect copyright inWeChat public platforms and handle the dispute quickly.
