摘要
随着《国际海运条例》的实施,无船承运业务从传统的国际货运代理业务中分离出来。新旧法的冲突导致了国际货运代理人和无船承运人在身份上的混同。文中在对国际货运代理人与无船承运人的身份进行辨析识别的基础上,进一步分析和提出我国在两者身份认定上存在的问题和建议。
With the implementation of International Maritime Regulations ,the non vessel operating common carrier (NVOCC) businesshas been independent from the traditional international freight forwarding business.However,the conflict between the existing laws and expired laws leads to the confusion of the international freight forwarder and NVOCC in identity.Based on the analysis and identification of the status of the international freight forwarder and the non vessel operating common carrier, the paper further analyzes and puts forward the problems and suggestions on the identification of the two identities.
