论模拟法庭教学的基本思路

On Basic Ideas of Moot Court Teaching

对于模拟法庭教学存在的缺陷及相应对策,学界已从不同角度进行了分析,但对于模拟法庭的基本特征、教学的基本思路等问题尚缺乏深入探讨。通过文本比较和实地观察可知,模拟法庭具有的虚假性、戏剧性、对现实的高仿性和依赖性、技能训练的残缺性等基本特征,是模拟法庭教学面临的基本事实条件。在理论上探讨如何克服上述特征的研究以及在实践中想方设法改变上述基本特征的做法并不可取。因此,应当充分把握并利用模拟法庭的基本特征,切合实际地安排教学内容,进行教学设计。模拟法庭教学可以按照课程定位、容量、内容策划、效果检验与评价等模块进行设计。

The defects of moot court teaching as well as corresponding countermeasures have been discussed in academia from different aspects. But there is no in-depth study on the basic characteristics and teaching design of moot court. Through the field observation and text -comparison, we can know that moot court is mostly false, theatrical, high imitating to real court, and incomplete in skills training, which are the characteristics of moot court teaching. It is not desirable to overcome the defects by theoretical research or find ways to change the characteristics in practice. It is essential to fully use the basic characteristics of the moot court to arrange and design the teaching. The moot court teaching can be designed according to the course orientation, capacity, content planning, effect inspection and evaluation.
