最高人民法院具体应用法律解释权的规范分析

Analysis of the Norms of the Supreme People's Court in Applying the Power of Legal Interpretation

《人民法院组织法》和有关法律规定,最高人民法院就审判活动中如何具体应用法律问题拥有解释权,该解释权是最高国家权力机关为了司法权的统一特别赋予最高人民法院的规范解释权,并不意味各级人民法院和法官在法律适用中的裁量解释权被剥夺。在现实中,最高人民法院的司法解释有些已经明显超越了法律赋予的行使解释权的范围,呈现出"立法化"的倾向,所以最高人民法院行使规范解释权必须接受全国人大常委会的监督,不得侵犯全国人大常委会的法律解释权。

The Organizational Law of the People’s Court and other relevant laws have given the Supreme People’s Court the power of interpretation on how laws are specifically used in judicial activities. This normative power of legal interpretation is granted by the organ of the highest state power for the purpose of unifying the judicial power,but this authorization does not mean the people’s courts and judges of all levels are deprived of rights of discretion and interpretation in legal applications. In practice,however,some of the judicial interpretations clearly suggest that the Supreme Court has gone beyond the power endowed by the law,presenting a tendency of“legislation”. Therefore,the Supreme Court’s normative power of interpretation should accept the supervision of the standing committee of the National People’s Congress and should not,on the contrary,infringe upon the power of legal interpretation of the standing committee.
