地方立法调研规范化研究

On the Standardization of Local Legislative Investigations

地方立法调研具有极其重要的价值和功能,但由于《中华人民共和国立法法》对立法调研这一深刻影响立法科学性、民主性和人民性的规定语焉不详,导致各地方立法条例对立法调研的规定较为粗疏,难以为地方各类立法调研提供统一、明确的指导。在中央要求发挥立法机关主导立法的背景下,在地方立法权急遽扩容的当下,有必要制定统一立法调研规程,对地方立法中各种调研主体的调研和立法不同环节中的调研进行规范,同时,强化对调研报告和成果的甄别、使用、保存和分析的规范,明确不合规范的立法调研的处理方式和应当承担的法律责任。

Local legislative investigation has extremely important value and function,affecting the legislative natures of being scientific,democratic,and beneficial to the people. However,the Legislation Law of the People's Republic ofChina does not specify these characteristics,resulting in the vagueness in local legislative regulations regarding legisla-tive investigation,which fails to provide a unified and clear guidance for the local legislative investigations. In the back-ground that the legislature is requested to lead legislation and that local legislative power is rapidly expanding,it is nec-essary to formulate a unified legislative investigation procedure to regulate the various main bodies of investigation anddifferent legislative links in the process of local legislation;at the same time,to standardize the norms of examining,uti-lizing,preserving,and analyzing investigation reports and results;and to specify punishment and legal responsibilities for nonstandard legislative investigations.
