高校学生管理中大学生人格权的保护——基于大学生法律地位的特殊性

Protecting Undergraduates' Right of Personality in College Student Management—Based on the Particularity of Undergraduates' Legal Status

人格权是自然人与生俱来的,是民事主体独立人格所必备的权利。大学生作为具有双重身份的"社会人"和"学校人",其人格权不论在与学校的何种法律关系中都受到法律保护,高校学生管理中应予以重视和保护。本文通过分析大学生人格权在宪法、行政法律关系、民事法律关系以及教育法律关系中的特殊性和高校学生管理中存在的问题,建议通过增强大学生人格权保护意识、完善相关法律法规体系、树立以学生为本的教育观念和建立健全校内申诉制度来促进高校学生管理法治化。

The right of personality,which natural person born with,is the necessary right for civil subject independent personality.As "social man" and "school man",undergraduates' right of personality is protected in every legal relation.And college student management is supposed to pay more attention to it.The thesis is aiming at promoting legalization of college student management by analyzing the particularity of undergraduates' right of personality in Constitution,Administrative Laws,Civil Laws,Education Laws. Meanwhile,the thesis also offers some practical proposals to solve issues that exist in college student management.
