是否"能从原申请记载的信息中直接地、毫无疑义地确定"是判断专利文件的修改是否符合专利法第33条的规定的一个难点。本文结合两件具体案例说明技术方案的整体考量在该判断过程中的重要性。

The principle of direct and unambiguous determination from original disclosure regulated under Article 33 of the patent law is deemed to be difficult to grasp during practical judgment. In the present text the importance of anoverall consideration on the solution in the procedure of the judgment is proposed in conjunction with two specificcases.
