摘要
2012年修改后刑事诉讼法构建了具有我国本土特色的刑事强制医疗制度,标志着我国刑事诉讼程序步入了精细化、科学化的发展轨迹。强制医疗解除制度承载着程序正义、人权保障与平衡社会利益与个人自由三方面的价值,但从司法适用的角度来讲,还存在着强制医疗机构模糊、"定期诊断评估"的具体期限不明等诸多争议,有必要对强制医疗解除中具体的交付执行机构、定期诊断评估的期限以及审判机关的决定程序问题做进一步的明确。
The criminal procedure law was revised in 2012 to include a compulsory medical treatment system with Chinesecharacteristics, which marks fine and scientific development of China’s criminal procedure. Provisions on ending of the compulsorymedical treatment system area valuable in three aspects: procedural justice, human rights protection and balancing social interests withindividual freedom. But from the perspective of judicial application, there are some disputes over its problems, including unspecifiedmandatory medical institutions, unspecified period for “regular diagnosis and assessment”. It is necessary to clarify the enforcementagencies, the time limit for regular diagnosis and assessment, and the proceedings for the decision of the court.
